VOID WEAVER
These Terms and Conditions of Use (the “Terms”) govern access to and use of the video game VOID WEAVER (the “Game” or the “Service”), available at voidweaver.online and, upon release, through the Google Play Store and Apple App Store, developed and operated by Binatomy S.r.l., with registered office at Via Mentana 9, 57125 Livorno (LI), Italy, VAT and Tax Code IT02071300491 (“Binatomy”, the “Controller”, or “we”).
By using the Game, the user (the “User” or “you”) declares that they have read, understood, and fully accepted these Terms, as well as the Privacy Policy, which forms an integral part of them. If you do not accept these Terms, you may not use the Service.
VOID WEAVER is a “bullet-hell roguelite” video game, playable via web browser and, subsequently, through Android and iOS applications. The Game can be used in guest mode, without creating an account, or with a registered account to enable cloud saving of progress and access to additional features (global leaderboard, cumulative statistics, trophy system).
Binatomy reserves the right to modify, expand, reduce, or suspend the Service's features at any time, providing prior notice to registered Users where reasonably possible, without this giving rise to any right to compensation or indemnity.
Creating an Account is optional and is performed via Firebase Authentication using an email address and password. Login credentials are managed and encrypted directly by Firebase (Google); Binatomy does not have access to the password in plain text.
The User undertakes to provide a valid email address and to keep their login credentials confidential, being responsible for all activity carried out through their Account.
Use of the Service with Account creation is permitted to individuals who are at least 14 (fourteen) years of age. Users below this age may use the Game in guest mode, without creating an Account and without processing of identifying personal data, or with an Account created and managed by a parent or legal guardian, who assumes full responsibility for it.
The nickname chosen by the User (or automatically derived from the prefix of the email address) is publicly visible on the global leaderboard. The User undertakes not to use, as a nickname, their real first and last name, identifying data of third parties, or content that is offensive, discriminatory, defamatory, or otherwise contrary to law or common decency. Binatomy reserves the right to modify or remove non-compliant nicknames without prior notice.
All Game Content is the exclusive property of Binatomy or its licensors and is protected under Italian and international copyright, trademark, and intellectual property law.
Binatomy grants the User a personal, non-exclusive, non-transferable, revocable, and limited license to use the Service for strictly recreational and personal purposes. The User is expressly prohibited from: reproducing, distributing, modifying, decompiling, or reverse-engineering the Game Content; commercially exploiting, in whole or in part, the Service without Binatomy's prior written authorization; using bots, scripts, exploits, cheats, or automated tools that alter the normal functioning of the Game or the integrity of the leaderboard.
When using the Service, in particular in modes involving interaction between Users (co-op, leaderboard), the User undertakes to:
In the event of a breach of these Terms, Binatomy reserves the right to suspend or terminate, temporarily or permanently, access to the Service and the Account, at its reasonable discretion and, where possible, following notice to the User.
The cooperative game mode (co-op) allows two Users to connect their devices directly in order to play together, without gameplay data (positions, game inputs) passing through or being stored on Binatomy's servers. Establishing this direct connection requires a brief initial technical exchange of information between the two devices, which involves exposing the IP address of the Users involved, as further described in the Privacy Policy.
Binatomy cannot guarantee the absence of malfunctions, latency, or interruptions in co-op sessions, which depend on the network conditions of the Users involved.
The Service may include advertising space provided by third parties (Google AdMob for mobile applications, Google AdSense for the web version), in rewarded formats (e.g., to continue a run or obtain in-game rewards), interstitial ads, and banners. For details on the data processed for advertising purposes, please refer in full to the Privacy Policy.
Binatomy is not responsible for advertising content displayed by Third Parties, without prejudice to its own diligence in selecting providers that comply with applicable law.
As of the date of these Terms, the Service does not include in-app purchases, subscriptions, or transactions of any kind. Binatomy therefore does not collect any payment data. Should purchase features be introduced in the future, these Terms will be updated accordingly and communicated to Users.
The Service is provided “as is” and “as available.” To the maximum extent permitted by applicable law, Binatomy does not warrant that the Service will be free of errors, interruptions, or defects, and is not liable for any loss of Progress Data resulting from technical malfunctions, Service interruptions, force majeure events, or the User's own conduct.
Nothing in these Terms limits Binatomy's liability for willful misconduct or gross negligence, nor any other right of the User that cannot be waived under applicable law, including consumer protection provisions.
The User may request deletion of their Account and related Progress Data at any time, in accordance with the procedures set out in the Privacy Policy. Binatomy may suspend or terminate a User's Account in the event of a breach of these Terms, prolonged inactivity, or discontinuation of the Service.
Binatomy reserves the right to modify these Terms at any time, to reflect regulatory, technical, or organizational developments of the Service. Changes will be communicated by publishing the updated version on the website and, where technically feasible, via an in-app notice. Continued use of the Service after publication of the changes constitutes acceptance thereof.
These Terms are governed by Italian law. For any dispute concerning their interpretation, validity, or performance, where the User qualifies as a consumer under Legislative Decree 206/2005 (Italian Consumer Code), the courts of the consumer's place of residence or domicile shall have jurisdiction. In all other cases, the Court of Livorno shall have exclusive jurisdiction.
